“Discover More with NovaSeq” Contest – Full Terms and ConditionsPlease read the following terms and conditions carefully. By submitting your entry form, you agree to these terms and conditions for yourself and on behalf of your Institution/Company. “You” and “your” shall refer to you personally or your Institution/Company, as applicable. How to Enter “Discover More with NovaSeq” Contest (“Contest”): 1) Submit your entry by completing the online entry form, only complete applications will be reviewed. 1. To have your submission considered, all entries must: • Be in English (all social media postings, video content, images, etc.) • Be complete • Be an original work • Comply with all terms and conditions listed herein Eligibility 2. Contest is limited to the residents of Australia and New Zealand only. Contestants must be at least 18 years of age at the time of entry. 3. Employees of Illumina and/or their family members and/or anyone else connected in any way with the Contest and/or helping to set up the Contest; and/or healthcare professionals (as defined by Illumina’s policies on health care professionals) are not eligible to participate in this Contest. 4. Any questions regarding the eligibility or appropriateness of any submissions, for consideration in the Contest shall be resolved by Illumina in its sole discretion. Illumina reserves the right to disqualify any entries by persons (i) who do not satisfy the terms and conditions and/or (ii) who submit false or misleading entry information. 5. Applicants must be employed by a University, Medical Research Institute, publically or government funded research institute of hospital. Winner Selection 6. One winner will be selected from eligible entries received. The selection will be made by a selection panel consisting of 3 Illumina employees and a representative from each service provider (the “Selection Panel”). The Selection Panel reserves the right to contact the applicant to request more information in the decision making phase. The decision of the Selection Panel will be final. The Selection Panel will choose the winner at their discretion based on criteria such as unique nature of research, the ability of the applicant to demonstrate funding and future expansion of the project and the ability to promote sequencing to a wide audience. The winner will be will be announced via social media and an email will be sent to registered contestants. 7.This contest will be run quarterly throughout 2018. Quarter 4 (Oct 1st, 2018 – 30th December 2018) will end at 11:59:59 pm AEST on December 30th, 2018 and the winners will be announced on December 31st, 2018. Submissions after this time will automatically be included for consideration in Quarter 4 judging. 8. If the winner cannot be contacted or does not claim the prize within 14 days of announcement, Illumina reserves the right to withdraw the prize from the winner and pick replacement winner. Prizes 9. The prize is as follows: A chance to win a sequence run on an Illumina NovaSeq, via your choice of service provider. i.e. Illumina will make available an instrument to be used for 1 (one) sequence run only for samples to be provided by the winner. The winner is responsible for all costs outside of the supplied sequencing run (i.e. DNA/RNA Extraction/isolation, QC, Library Prep, Bioinformatics, etc.). The output from the run will be provided to the winner. The prize is not negotiable and there is no cash alternative for the prize except that Illumina reserves the right to substitute an alternate prize of equal or greater value to the prize set out above if the prize referred above cannot be provided for reasons outside Illumina’s control. The prize does not include any items (such as any incidental costs, transportation, taxes, duties etc.) other than those noted above. Any costs incurred by the winner to claim the prize and/or that are incidental to the fulfilment of the prize are the responsibility of the winner. Illumina does not accept any responsibility if the winner(s) are not able to take up the prize. Sample Submission Samples will be run by your choice of Illumina service provider. All samples submitted for a sequencing run must adhere to the guidelines for each service provider. 10. Ramaciotti Centre for Genomics: The successful recipient can utilize the Centre’s library prep service in discussion with the service provider. All samples or libraries submitted for Quarter 4 must pass a quality check prior to 31st December 2018 All samples or libraries submitted for the sequencing run must be submitted in a format that conforms to Ramaciotti Centre for Genomics guidelines. 11. Australian Genome Research Facility (AGRF): The successful recipient can utilize the Centre’s library prep service in discussion with the service provider. All samples or libraries submitted for Quarter 4 must pass a quality check prior to 31st December 2018. All samples or libraries submitted for the sequencing run must be submitted in a format that conforms to AGRF submission guidelines. Limitation of Liability 12. In no event shall illumina, its officers, directors, employees, or agents, be liable for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever arising under or as a result of entrance in or participation in the contest, whether based on warranty, contract, tort, strict liability, or any other legal theory, and whether or not illumina is advised of the possibility of such damages. the foregoing limitation of liability shall apply to the fullest extent permitted by law. General 15. By entering this Contest, you agree to obtain all authorizations and permissions from your Institution/Company or others that are required to allow you to make this submission. You further agree that your creative design, name, and institution’s name may be used for all purposes, including marketing, by or through Illumina or its affiliates without any compensation and with or without attribution, regardless of whether your entry wins the Contest. You hereby irrevocably grant Illumina the right and license to use your submitted content as aforesaid and shall execute any further or other documents as may be needed to grant such rights. 16. You represent and warrant that the use of your creative design submission by Illumina does not violate any rule, policy, copyright, trademark, patent, or procedures of your Institution/Company or that of any other person 17. You acknowledge and agree that any submission made hereunder is not being made in exchange for any promise of business to Illumina. You also agree and acknowledge that Illumina will retain a copy of outcome of the prize run and may publish this outcome at its discretion. 18. By entering this contest you agree that Illumina may contact you for purposes of marketing its products and services. 19. By entering this contest you agree to the use of your name and image in any publicity material generated by or through Illumina. Any personal data relating to the winner or any other contestants will be used solely in accordance with current Australia and New Zealand data protection legislation and will not be disclosed to a third party without the contestant’s prior consent. 20. Once submitted, all Contest entries and any accompanying materials and information will become Illumina’s property and will not be returned. By entering this Contest and submitting your materials, you hereby irrevocably transfer and assigns to Illumina, its successors and assigns, in perpetuity, all right (whether now known or hereinafter invented), title, and interest, throughout the world, including any copyrights and renewals or extensions thereto in your entry and accompanying materials and further waive any moral rights in and to such works. 21. Illumina reserves the right to discontinue or modify this Contest at any time for any reason. In such event, Illumina will post a notice on this website and inform all already registered contestants via e-mail. In the event of discontinuance, Illumina will have no liability to you, your employees, and agents or team members for such cancellation or modification. 22. Illumina may refuse to consider an entry submission or award a prize if Illumina determines in its sole discretion that the provision of either would likely result in a violation of an applicable law, rule, or policy, including, but not limited to, if contrary to the law where you reside. 23. This Contest is based on skill alone and is not dependent on chance. 24. Each applicant is responsible for all of his/her own costs, and the costs of employees and agents, incurred or that may be incurred in connection with this Contest, including, without limitation, any tax liability (including any income tax associated with the value of the award), and any costs associated with entering into and participating in this Contest. 25. Any and all actions, claims, disputes, or controversies relating to this Contest shall be governed by the laws of the State of Victoria, Australia, without regard to its conflict-of-laws principles. By submitting your entry, you expressly consent to the exclusive forum, jurisdiction, and venue of the state and federal courts of Melbourne, Victoria, Australia, in such actions, claims, disputes, or controversies. 26. This Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Instagram or any other social network.
